Receiving a DWI charge is confusing and overwhelming, but having an out of state license makes the situation even more complicated. However, our firm is North and South Carolina licensed, and we are ready to help.
Civil Revocation
Just as a North Carolina driver will have his or her license suspended for 30 days for refusing to submit to a breath/blood test or registering a .08 or more on the test, South Carolina drivers will face the same revocation. However, this revocation only applies within the state of North Carolina. This means that your South Carolina license is still valid to drive outside of North Carolina. Many charging officers will take your physical license as well, even though they are not supposed to do so. In Mecklenburg County and other counties, we can have your physical license back immediately.
If you need to drive within the state of North Carolina, there are several privileges and hearings available to restore your driving privileges, but you must act quickly before time expires on their availability.
Sentencing
If you plead or are found guilty of driving while impaired, you will face the same consequences as a North Carolina driver, but you will also be required to complete South Carolina license restoration procedures. One of these extra steps is to complete an assessment through ADSAP before your license is fully restored.
If you have a South Carolina license but are facing a DWI charge in North Carolina, we are ready to help guide you through the process and defend your rights.
